General Terms and Conditions of Carriage for Ropeway Services

Chapter 1: General Provisions
(Scope of Application)
Article 1

Transportation contracts relating to the ordinary ropeway operations managed by our company shall be governed by these Terms and Conditions of Carriage; matters not provided for herein shall be governed by applicable laws and regulations or general commercial practices.

(Instructions from staff)
Article 2

Passengers and shippers must comply with any instructions given by our conductors or other staff in the course of their duties to ensure the safety of transportation and maintain order.

Chapter 2: Passenger Transportation
(Acceptance of Shipments)
Article 3

We accept passengers and their carry-on baggage for transport, except in cases where we refuse to accept or continue transport pursuant to the provisions of Article 4.

(Acceptance of Carriage; Refusal to Continue Carriage)
Article 4

We reserve the right to refuse to accept or continue the shipment if any of the following conditions apply.

If the application for such carriage is not in accordance with these Conditions of Carriage.

2

When there is no equipment suitable for the shipment in question.

3

When the applicant requests special arrangements regarding the shipment.

4

When the transportation in question violates the provisions of laws and regulations, public order, or public morals and customs.

5

Persons who are heavily intoxicated, children not accompanied by a guardian, or others deemed to pose a safety risk during transport.

6

Persons and luggage carrying items prohibited from being brought onto ropeway under the Railway Business Act.

7

When transportation is disrupted due to natural disasters or other unavoidable circumstances.

8

If you fail to follow the staff’s instructions.

9

Any person who causes or is likely to cause harm or inconvenience to other passengers.

10

In addition to the cases listed in the preceding paragraphs, when there is a valid reason.

(Shipping Restrictions)
Article 5

In the event of transportation disruptions caused by weather, natural disasters, or other unavoidable circumstances, we may limit passenger capacity or cargo weight, or suspend service.

(Possession of Tickets)
Article 6

Passengers and shippers may not board the train unless they are in possession of the required tickets (which include fare tickets and other tickets).

(Sale of Tickets)
Article 7

We sell general tickets at our own ticket offices and authorized sales locations, and group tickets and discount tickets at our directly operated ticket offices. In addition, ship and train tickets issued by contracted travel agencies must be exchanged for our tickets at the ticket office at the station of departure.

(Handling of Group Tickets)
Article 8

Group tickets are sold upon request to passengers who are part of a group of a certain size or larger traveling together on the same itinerary, provided that a representative or tour guide handles the payment for the entire group.

Student group tickets are available to individuals who meet the requirements of the preceding paragraph, specifically: students at schools as defined in Article 1 of the School Education Act; children at childcare facilities as defined in Article 39-2 of the Child Welfare Act; and students at vocational schools and other specialized schools, as well as their accompanying persons (including faculty and staff, contracted doctors and nurses, and any other personnel necessary to maintain order and ensure safety during group activities).

(Validity Period of Tickets)
Article 9

The validity period and other details of tickets shall be as indicated on the ticket.

(Validity of Tickets)
Article 10

Tickets are valid only when used in accordance with the conditions printed on them.

(Invalidation of Tickets)
Article 11

Any ticket that falls under one or more of the following categories shall be deemed invalid.

1

Those whose validity period has expired.

2

Tickets on which the printed information is no longer legible.

3

A document on which the information printed on the face has been altered.

4

When a commercial pass or other document bearing the user’s name is used by someone other than the named user or for a purpose other than its intended use.

5

Items obtained through fraudulent means or other methods that do not follow proper procedures.

(Presentation of Tickets)
Article 12

When passengers board, we require passengers and shippers to present their tickets at the ticket gates; in the case of employee tickets, we require them to be shown.

(Collection of Tickets)
Article 13

We will collect tickets held by passengers in the following cases:

When a passenger passes through the ticket gate to board a train.

2

When the ticket becomes invalid.

3

When a refund is issued for the ticket in question.

(Fares, Charges, and Application Methods)
Article 14

The fares and charges collected by our company from passengers or shippers, as well as the methods for their application, are based on the separately posted schedule of fares and charges and the applicable methods that have been filed with and approved by the Director of the Bureau of Transportation; they are also posted at each station.

(Free Transportation for Infants)
Article 15

We offer free admission to children under 6 years of age accompanied by a person 12 years of age or older, at a ratio of one child under 6 per one person 12 years of age or older.

(Refunds of Fares Due to Passenger Circumstances)
Article 16

If a passenger cancels a trip for personal reasons, the Company will charge a prescribed refund fee for each ticket and refund the fare in accordance with the provisions of the following items.

For unused regular tickets, the fare amount, provided the ticket is within its validity period.

2

For unused group tickets, the fare amount, provided they are within their validity period.

3

For round-trip tickets used as one-way tickets, the remaining fare after deducting the one-way fare, provided the ticket is used within its validity period.

(Surcharges, etc.)
Article 17

If a passenger falls under one or more of the following categories, the Company will collect from that passenger the standard passenger fare for the section of the journey traveled, as well as a surcharge equal to that amount.

If you refuse to surrender your ticket or other travel documents when requested to do so by our staff in accordance with the provisions of Article 13.

When boarding or attempting to board without a valid ticket.

(Loss of Tickets)
Article 18

If a passenger loses their ticket and our staff is unable to verify the loss, we will charge the standard passenger fare for the applicable travel section.

(Purchasing the wrong ticket)
Article 19

If a passenger mistakenly purchases the wrong ticket, and our staff confirms this fact, and provided that the ticket is still valid and unused, we will exchange it for the type of ticket the passenger requests. In such cases, we will compare the fare already collected with the fare for the exchanged ticket, collect any shortfall, and refund any excess amount. However, a prescribed handling fee will be charged in accordance with our refund policy.

(Procedures for Fare Changes)
Article 20

If we change our fares, tickets issued prior to the change will remain valid for the duration of their validity period, regardless of the fare printed on the ticket, and we will not charge or refund any difference from the original fare. (The same applies to other charges.)

(Handling of Passengers During Transport in the Event of Service Suspension)
Article 21

If our cable car service is suspended, we will refund the fare to passengers who are in the middle of their journey. However, this does not apply to passengers who use an alternative means of transportation provided by us at our expense.

(Where to Request a Refund)
Article 22

We process fare refunds at the following refund locations.

Standard tickets: All ticket offices that issue our tickets.

2

Ticket offices that sell discounted tickets.

3

Group tickets and the ticket office that issued them.

4

Ticket types issued by contracted travel agencies, or tickets exchanged for our company’s tickets at a ticket office. (The same applies to certificates of non-use, certificates of fare discrepancy, etc.)

(Rounding)
Article 23

When collecting or refunding fares and other charges, we round off any amounts less than 10 yen resulting from calculations.

Article 24

We do not accept shipments of luggage (meaning items entrusted to us for transport).

(Free personal items)
Article 25

In addition to their personal belongings, passengers may bring into the cabin, free of charge, carry-on items (meaning items carried by the passenger) that fall within the limits specified in the following items and meet one or more of the criteria listed below.

Items weighing less than 10 kg

Items with a volume of less than 0.025 cubic meters

3

Items less than 1.5 meters in length

4

Quantity: 1 or fewer

(Paid personal effects)
Article 26

Passengers may bring into the cabin, upon payment of the applicable fee for each item, any carry-on baggage (excluding items specified in Article 25) that falls under one or more of the following categories.

1

Items weighing between 10 kg and 30 kg

2

Items with a volume of 0.025 cubic meters or more but not exceeding 0.25 cubic meters

3

Items measuring between 1.5 and 2.0 meters in length

4

Quantity: 1 or more, but no more than 2

(Restrictions on Carry-On Baggage)
Article 27

Notwithstanding the provisions of Articles 25 and 26, we reserve the right to restrict or refuse the carriage of personal effects in the following cases:

Goods as defined under the Railway Business Act, Article 40 of the Ministerial Ordinance Establishing Technical Standards for ropeway Facilities, and Article 2 of the Public Notice Establishing Detailed Rules

If the carrier reasonably believes that a passenger’s carry-on baggage may contain items that violate Paragraph 1, the carrier may request that the passenger disclose the contents of the baggage; if the passenger fails to comply,

Where a passenger has disclosed the contents of personal effects under Item 2, and such contents are similar to or indistinguishable from the items listed in Item 1, and the passenger is unable to provide adequate proof that the items in question are not those listed in Item 1

Items that may pose a danger or cause a nuisance to other passengers

5

Items that may cause damage to ropeway equipment, such as carriers

Chapter 3: Responsibility
(Liability for Passengers)
Article 28

The Company shall be liable for damages resulting from injury to the life or body of a passenger caused by the operation of the regular ropeway managed by the Company.
However, this shall not apply if we or our staff can prove that we exercised due care in the operation of the cable car, that the passenger or a third party other than our staff acted with intent or negligence, or that there were no structural defects or operational malfunctions.

(Liability for Personal Belongings, etc.)
Article 29

The Company shall not be liable for any damages resulting from the loss or damage of passengers’ personal belongings, clothing, eyeglasses, watches, or other personal items in connection with the operation of the regular ropeway managed by the Company.
However, this shall not apply if the Company or its employees are at fault for such loss or damage.

Article 30

Our liability for carriage begins when the passenger presents instructions regarding the ticket referred to in Article 12, and ends when the passenger leaves the platform at the destination station.

(Liability for Measures Taken in Response to Natural Disasters, Severe Weather, and Similar Events)
Article 31

The Company shall not be liable for any damages incurred by passengers as a result of the suspension of operations or other measures taken when it is impossible or difficult to ensure the safety of transportation due to natural disasters, weather conditions, or other causes.

(Passenger Liability)
Article 32

If the Company suffers damage due to the willful act or negligence of a passenger, or due to the passenger’s failure to comply with laws and regulations or the provisions of these Conditions of Carriage, the Company shall seek compensation for such damage from the passenger.

(Prohibited Passenger Conduct)
Article 33

Passengers must not engage in the following acts.

Toy fireworks weighing more than 100 grams

Gasoline, kerosene, diesel fuel, alcohol, carbon dioxide, and other flammable liquids
(excluding those used in cigarette lighters and portable heaters)

Film weighing more than 100 grams, and other celluloid products (including fabrics, semi-finished products, and waste made primarily from nitrocellulose)

5

Yellow phosphorus, calcium carbide, metallic sodium, other flammable substances, and magnesium powder, hydrogen peroxide, sodium peroxide, and other explosive substances

6

Caustic soda, nitric acid, sulfuric acid, hydrochloric acid, and other corrosive substances

7

High-pressure gas (as defined in the High-Pressure Gas Control Act, Act No. 204 of 1951)

Chloropicrin, methyl chloride, liquid hydrocyanic acid, chloroform, formalin, and other toxic gases and substances that may generate toxic gases

Matches weighing more than 500 grams

Batteries (excluding dry cell batteries)

In addition to the items listed in the preceding subparagraphs, any other items that may pose a danger to other passengers

Appendix 2
1

Gunpowder

  • Firearms primers and signal primers weighing no more than 300 grams, provided they are contained in a container that prevents ignition due to vibration, impact, or similar causes
  • Signal fuses and signal fuse links weighing no more than 500 grams
  • Competition-grade paper detonators weighing no more than 100 grams
  • Live rounds and blank cartridges, not exceeding 50 in number, that are loaded into a cartridge belt or cartridge pouch
  • Live ammunition and blank cartridges loaded into firearms (limited to cases where police officers or other persons authorized by law to carry firearms for official duties bring such ammunition into the aircraft)

In the case of flammable liquids, those that fall under any of the following categories

  • Containers holding no more than 0.5 liters, sealed in a leak-proof container and packaged in such a way as to prevent damage to the container
  • Flammable paints weighing no more than 10 kilograms and sealed in metal containers

In the case of celluloid products, those that fall under any of the following categories

  • Items weighing no more than 300 grams and packaged in paper boxes or other electrically insulating materials
  • Cinematographic film that is placed in a container made of non-flammable electrical insulating material, such as fiber, and secured in such a way that the lid cannot open due to vibration, impact, or similar forces
  • Cinematographic film that is placed in a film container and further placed in a canvas bag (limited to bags made of No. 8 cotton canvas as defined in Japanese Industrial Standard L3102, or canvas of equivalent or greater thickness and strength, featuring a double bottom, fitted with an upper or middle cloth cover, and containing no metal parts)

Carbide in a dry state weighing no more than 25 kilograms, sealed in a container that is not likely to break

Photographic flash powder weighing no more than 500 grams, sealed in a container that prevents spillage and packaged in such a way as to prevent the container from breaking

With respect to corrosive substances, those that fall under any of the following categories

  • Containers holding no more than 0.5 liters, sealed in a leak-proof container and packaged in such a way as to prevent damage to the container
  • Individual items of deleterious drugs / powerful drugs weighing no more than 25 grams, sealed in a container that is unlikely to break

In the case of high-pressure gases, carbon dioxide contained in fire extinguishers and oxygen contained in medical oxygen cylinders

Liquid hydrocyanic acid, chloroform, and formalin in quantities not exceeding 0.5 liters, provided they are packaged in such a way as to prevent leakage

Batteries that are packed in a sturdy wooden box and secured so that the terminals are not exposed

Behaviors that interfere with safe driving.

Any act that violates laws and regulations or these Terms and Conditions of Carriage.

Behavior that causes inconvenience to other passengers.

Supplementary Provisions
These Terms and Conditions of Carriage shall take effect on November 1, 1998.
